UEFA approves final format and access list for its club competitions as of the 2024/25 season
https://www.uefa.com/returntoplay/news/ ... -approved/

Following an exhaustive consultation with stakeholders in the game, the UEFA Executive Committee has today in Vienna approved the final format and access list for European club competitions as of the 2024/25 season further to its decision of 19 April 2021 to introduce the so-called “Swiss system”.

The key amendments relate to the reduction from 10 matches to 8 in the league phase of the UEFA Champions League and the change of criteria for the allocation of two of the four additional places in the UEFA Champions League, removing access based on club coefficient. This confirms UEFA’s strong commitment to the principle of open competitions and sporting merit, while recognising the need to protect domestic leagues.

The eight matches of the UEFA Champions League will be played over the ten European weeks foreseen by the decision made in April 2021. The UEFA Champions League, UEFA Europa League and UEFA Europa Conference League will all enjoy one week of calendar exclusivity.

The four additional places created by the increase from 32 to 36 teams in the league phase of the UEFA Champions League will be allocated as follows:
• One place will go to the club ranked third in the championship of the association in fifth position in the UEFA national association ranking.
• One place will be awarded to a domestic champion by extending from four to five the number of clubs qualifying via the so-called “Champions Path”.
• The final two places will go to the associations with the best collective performance by their clubs in the previous season (total number of points obtained divided by the number of participating clubs). Those two associations will earn one place for the club best ranked in the domestic league behind the UEFA Champions League positions. For example, at the end of the current season the two associations adding one club to the Champions League, based on the collective performance of their clubs would be England and the Netherlands.

• The UEFA Executive Committee once again confirmed that all games before the final will still be played midweek, recognising the importance of the domestic calendar of games across Europe.

Commenting on the decisions, UEFA President Aleksander Čeferin, said:

“UEFA has clearly shown today that we are fully committed to respecting the fundamental values of sport and to defending the key principle of open competitions, with qualification based on sporting merit, fully in line with the values and solidarity-based European sports model. Today’s decisions conclude an extensive consultation process during which we listened to the ideas of fans, players, coaches, national associations, clubs and leagues to name but a few, with the aim to find the best solution for the development and success of European football, both domestically and on the international club stage. We are convinced that the format chosen strikes the right balance and that it will improve the competitive balance and generate solid revenues that can be distributed to clubs, leagues and into grassroots football across our continent while increasing the appeal and popularity of our club competitions”

“I am really pleased that it was a unanimous decision of the UEFA Executive Committee, with the European Club Association, European Leagues and National Associations all agreeing with the proposal made. Another proof that European football is more united than ever. Qualification will thus remain purely based on sporting performance and the dream to participate will remain for all clubs.”

Format summary

Taking the total number of teams from 32 to 36 in the UEFA Champions League, the biggest change will see a transformation from the traditional group stage to a single league phase including all participating teams. Every club will now be guaranteed a minimum of 8 league stage games against 8 different opponents (four home games, four away) rather than the previous six matches against three teams, played on a home-and-away basis.

The top eight sides in the league will qualify automatically for the knockout stage, while the teams finishing in ninth to 24th place will compete in a two-legged play-off to secure their path to the last 16 of the competition.

Similar format changes will also be applied to the UEFA Europa League (8 matches in the league stage) and UEFA Europa Conference League (6 matches in the league stage) and both will also include 36 teams in the league phase.

FIFA suspends India's FA because of 'undue influence from third parties,' strips country of U17 Women's World Cup
https://edition.cnn.com/2022/08/16/foot ... index.html
https://www.bbc.com/sport/football/62556926
India's highest court had disbanded the All India Football Federation (AIFF) in May and appointed a three-member committee to govern the sport.
The ruling from football's governing body comes after India's Supreme Court appointed the committee to take over the "day to day governance" of the AIFF in May after its president, Praful Patel, failed to hold elections originally scheduled for December 2020.
Fifa's member federations must be free from legal and political interference.

"The suspension will be lifted once an order to set up a committee of administrators to assume the powers of the AIFF Executive Committee has been repealed and the AIFF administration regains full control of the AIFF's daily affairs," Fifa added.
"FIFA is in constant constructive contact with the Ministry of Youth Affairs and Sports in India and is hopeful that a positive outcome to the case may still be achieved."

CoA Statement
https://www.the-aiff.com/article/coa-statement

NEW DELHI: The Committee of Administrators (CoA) has expressed its surprise and disappointment at the recent turn of events, by dint of which, the All India Football Federation has been suspended by FIFA, the governing body of world football, from August 14, 2022 until further notice, as per a letter from Fatma Samoura, Secretary General, FIFA, on August 15, 2022.

The CoA is surprised that the FIFA decision has come when extensive discussions were going on for the past few days between all stakeholders, including FIFA-AFC, AIFF, CoA, and the Sports Ministry as per the Order of the Supreme Court. While the CoA was committed to implement the Hon’ble Supreme Court’s Order regarding the elections of the AIFF, passed on August 3, 2022, it was also in constant dialogue with all stakeholders.

In the discussions held among the FIFA-AFC, AIFF, CoA, and the Sports Ministry in the past few days, it was suggested that the present elections of the AIFF Executive Committee may be conducted with the Electoral College consisting of 36 state representatives.

It was also suggested by FIFA through the Sports Ministry that the EC may consist of 23 members, including six eminent players. The 17 members (inclusive of the President, a Secretary General, a Treasurer, one Vice President, and one Joint Secretary) will be elected by the above electoral college. Out of the six eminent players, four will be men, and two women. The eminent players may be nominated (co-opted) in the EC and shall have the voting rights, thus making it above 25 percent of the EC.

The abovementioned points, the CoA strongly feels, are very much in sync with the letter issued by FIFA-AFC to the AIFF Acting General Secretary on July 25, 2022. The letter said: “As per the draft Statutes shared with us, there will be an additional 36 Eminent Players in the AIFF Congress from the existing 36 Member Association. Although we agree that the players’ voice needs to be heard, we are also of the view that the importance of the existing members of AIFF should not be undermined. However, we understand the requirements of the Sports Code of India and recommended AIFF to bring in a presence of above 25 percent of the Eminent Players in the AIFF Executive Committee as Co-opted Members.”

The CoA also made all arrangements as per the Order of the Hon’ble Supreme Court, to conduct the AIFF elections under an independent committee, consisting of eminent and highly reputed election officers. This too, is in line with the FIFA letter dated August 15, 2022, which says: “Concurrently, an independent electoral committee to be elected by the AIFF general assembly to run the elections of a new executive committee.”

In light of the above, the CoA is surprised by the world body’s decision to slap the suspension on Indian Football in the midst of discussions going on among all stakeholders to find the best possible solution in the current situation. The fact that while the letter dated August 15, 2022, from FIFA stated that Indian Football, was being suspended from August 14, 2022, the discussions between the world body and all stakeholders in India were in full swing till late in the day on August 15, 2022.

CoA chairman Justice (retd.) Anil Dave said, “It is unfortunate to see such a directive by FIFA during a time when all efforts were being made to put Indian Football back on the right track. That being said, we are constantly in talks with all the stakeholders, including FIFA, to find the correct solution to this situation, and get the ball rolling once again.

“It is really deplorable that for almost last two years, the body, whose term had already been completed, had continued in an absolutely undemocratic and illegal manner, no action was taken. But when the Hon’ble Supreme Court passed an order to set things right so as to see that a democratically elected body takes charge, and when the CoA and the Sports Ministry were doing their best for the implementation of the Order of the Hon’ble Supreme Court, the order of the suspension was passed by FIFA.”

CoA member Dr. SY Qureshi stated, “The recent suspension of the FIFA comes as a surprise to us all, especially since we had already found mutually accepted terms. Besides, democratic elections to elect a General Body were already on the way. However, we are hopeful that all problems will be solved to restore normalcy at the earliest.” Former India captain and the third member of the CoA, Bhaskar Ganguly said, “When a sincere effort was being made by the CoA to give due importance to the players, who are really interested in the sport, as per the spirit of the National Sports Code of India, the order of suspension has been slapped. All efforts were made by the CoA to see that the Constitution of AIFF is being framed as per the Order passed by the Hon’ble Supreme Court and the National Sports Code. It is really sad.”

FIFA lifts suspension of Pakistan Football Federation

The Bureau of the FIFA Council decided on 29 June 2022 to lift the suspension that was imposed on the Pakistan Football Federation (PFF) in April 2021 due to undue third-party interference.

The decision was taken after FIFA received confirmation that the normalisation committee of the PFF had regained full control of the PFF’s premises and was in a position to manage its finances.

The PFF was also informed that any undue interference in its affairs or action that could hinder the fulfilment of the mandate of the normalisation committee might lead to the PFF being suspended again and/or the imposition of other sanctions provided for in the FIFA Statutes.

FIFA lifts suspension of All India Football Federation

The Bureau of the FIFA Council has decided to lift the suspension that was imposed on the All India Football Federation (AIFF) due to undue third-party influence.

The decision was taken after FIFA received confirmation that the mandate of the committee of administrators that was set up to assume the powers of the AIFF Executive Committee had been terminated and that the AIFF administration had regained full control of the AIFF’s daily affairs. FIFA and the AFC will continue to monitor the situation and will support the AIFF in organising its elections in a timely manner.

Youness Bengelloun v. FIFA & PFC CSKA-Sofia

2. Sporting succession of clubs in disciplinary cases

With regard to the merits of the case, the Panel had first to determine whether the Second Respondent was to be considered as the sporting successor of CSKA, the entity which had been the Appellant’s employer and the party ordered by the FIFA DRC Decision of 21 May 2015 to pay certain amounts to the Appellant.

The Panel found that sporting succession of clubs was to be decided on a case-by-case basis taking into account the circumstances of each individual case. It held that it can occur even in the absence of formal legal links between the two entities (such as the purchase of the former’s assets or federative rights) and, as such, had to be distinguished from legal succession and made subject to the test of sporting criteria only. In the view of the Panel, this reflected to a large extent the fact that, on the one hand, a club was a sporting entity identifiable by itself that, as a general rule, transcended the legal entities which operated it. Thus, the obligations acquired by any of the entities in charge of its administration in relation with its activity had to be respected.

On the other hand, the identity of a club was constituted by elements such as its name, colours, fans, history, sporting achievements, shield, trophies, stadium, roster of players, historic figures, etc. which distinguished it from all the other clubs. Hence, the continuity and permanence over time of the sports institution prevailed over the change of the entity that managed it.

The Panel also held that the concept of sporting succession of clubs had to apply not only in cases regarding employment-related disputes decided on the basis of the FIFA Regulations on the Status and Transfer of Players (“RSTP”), but equally in cases concerning the application of Article 64 FDC, considering that Article 64 FDC sought precisely to ensure compliance with FIFA decisions on employment-related disputes decided on the basis of the FIFA RSTP.

In the instant case, the Panel noted that the Second Respondent had an almost identical name and the same emblem, colours and stadium as CSKA. Moreover, the Second Respondent’s website mentioned the history, trophies and sporting achievements of CSKA, thereby creating, knowingly and with no doubt, an image of continuity to the eyes of the general public, namely that CSKA and the Second Respondent were one and the same club. Therefore, the Panel confirmed the Appealed Decision with respect to the sporting succession question.
Čia puikiai tinka tiek FBK Kaunų, tiek Dainavų situacijai įvertinti sakyčiau.
The Panel felt comfortable in reaching this conclusion due to the fact that in other FIFA decisions involving the Second Respondent regarding the matter of CSKA’s sporting succession, the common conclusion had been that “on the basis of the information and documentation at hand, there is no other alternative but to conclude that the new Club, PFC CSKA-Sofia,
appears to be the sporting successor of the original Debtor, PFC CSKA Sofia”.

https://www.tas-cas.org/fileadmin/user_ ... -2022_.pdf
Nežinau kur tiksliai kelti tokį dalyką, bet radau įdomų teisinį precedentą apie kaip FIFA fiksuoja klubų teisinį vientisumą nacionalinės teisės kontekste (pavyzdys Estijoje):

@Makenzis nepatiks
11. The Estonian Football Association provided the Secretariat, on 6 May 2019, with its position regarding the allegations of the Creditor. The position of the EFA can be summarized as follows:
- Tartu Jalgpallikool Tammeka and the Debtor are not the same entity. The latter stopped participating in competitions organised by EFA on 2014 and was liquidated and disaffiliated from the EFA on March 2016.
- In Estonia, a legal entity is identified by its registry number. The Debtor’s code is 80078915 and the club was erased from the registry on 28 March 2016. On the other hand, the code of Tartu Jalgpallikool Tammeka is 80315611 and it is still registered at the present day. This proves that both clubs are two different legal entities.
<...>
In light of all the above, and since in the member of the Committee’s view the identity of a club is constituted by elements such as its name, colours, logo, fans, history, roster of players, stadium, etc, regardless of the legal entity operating it, the member of the Committee deems that, on the basis of the information and documentation at his disposal, he has no other alternative but to conclude that Tartu Jalgpallikool Tammeka appears to be the successor of Tartu Jalgpalliklubi Tammeka, and, as such, is liable for the debts incurred by the latter – namely the one related to the decision passed by the Dispute Resolution Chamber on 26 November 2015 – and that therefore, Tartu Jalgpallikool Tammeka is found to have infringed article 64 of the 2017 FIFA Disciplinary Code

UEFA bosas nežada išspirti Baltarusijos iš futbolo: „Būtų truputį populistiška“

Nors daugelis sporto šakų po vasario 24 dieną pradėtos Rusijos karinės invazijos į Ukrainą nusprendė eliminuoti tiek Rusiją, tiek Baltarusiją iš savo žemėlapio, tačiau šiuo keliu nepasuko Tarptautinė Europos futbolo asociacija (UEFA).

Daugeliui sporto gerbėjų gūžčiojant pečiais, UEFA vadovas Aleksandras Čeferinas teigė nematantis problemų baltarusiams kovoti atrankos varžybose.

„Truputį populistiška sakyti, kad reikia visus išmesti lauk. Šią akimirką nematome priežasčių tą daryti. Jei padėtis pasikeis, mes nedelsiant į tai reaguosime. Politikai turėtų gerbti mūsų sprendimus. Mes valdžios atstovams neaiškiname, kaip jie turi dirbti“, – „Sport Bild“ teigė UEFA bosas.

The authorisation from the ACPR enables the FCH to collect and process payments on behalf of clubs, in accordance with the European Union Payment Services Directive (PSD2). This means that the FCH now has the green light to get up and running.

The FCH has two main objectives. The first is to centralize, process and automate payments between clubs, initially relating to training rewards (training compensation and solidarity contributions), while the second is to promote financial transparency and integrity within the international transfer system.

It is estimated that close to USD 400 million should be distributed each year to training clubs, which currently only receive approximately USD 70-80 million.

Uefa to cut Euro 2028 qualifying groups amid declining TV interest
https://www.sportspromedia.com/news/eur ... adcasters/
Uefa plans to trim down the size of qualification groups for the men’s 2028 European Championship due to a lack of interest from television broadcasters, according to The Times.

European soccer’s governing body also ditches plans to expand Euros to 32 teams from 24.

The recent Euro 2024 qualification draw produced seven groups of five countries, with a further three groups containing six teams. Under the current system, each country is set to play ten qualifiers for a place at Europe’s flagship men’s international soccer competition.

However, The Times report says that Uefa’s member associations have been presented with a new proposal to cut groups down to a maximum of four or five nations. The idea was put forward at a recent meeting held in Frankfurt. The new format could mean teams play just six games to qualify for the competition but would also continue to give smaller countries opportunities to play marquee matches against bigger nations.

A source in the meeting told The Times that the proposal is in reaction to feedback received from broadcasters.

If the new format is pushed through, The Times added that Uefa’s Nations League competition would also need altering in order to accommodate additional games between countries of a similar ranking.
