A player in Lithuania was approached by a person calling himself Martin Kocis and offering him a trial in Lisbon, Portugal. Kocis didn’t mention any club name. The player received a contract for the trial and was asked to pay 1,000 euro. Kocis said that the club would reimburse the player at the trial.

The player refused the offer after checking FIFPRO information.

Once again, we received information about Martin Kois, who says he is a scout and is now approaching players while using the name Martin Kovalsky.

Last week, he cheated an English player, who thought he was going on trial at a Portuguese club. The player paid approximately 1,200 USD, expecting that he would be reimbursed upon arrival in Portugal.

Previously Martin Kois also used the name Martin Kocis.

Be vigilant when you are approached by an agent using the name Martin, regardless of the surname.

And: never pay an agent before signing a contract with a club.



This is a “global problem”, according to FIFPro, with victims in Australia, the Philippines, England, Finland, Lithuania, Zimbabwe, Liberia, Ghana, Paraguay and many other countries.

Later, one person not from ProStar hinted to me that I should look for a team myself. I came to my senses, all the championships had already started, and I had a downtime.

– Shabliy and ProStar – are they good or evil for Ukrainian football?

- Not good - that's for sure. In Ukraine they are considered top agents, but if you look into it, they are only good for Yarmolenko, Malinovsky, Mykolenko and other famous football players. ProStar is waiting for one of the players to make a splash so they can make money on them.

They have about 500 clients, it is clear that they cannot pay attention to everyone and they simply forget about many, as happened to me. But when one person staffs almost all Ukrainian teams, it is not good, - said Shchebetun.

LAT: FIFA statute esanti arbitražinė išlyga saisto agentą ir futbolo klubą ginče dėl komisinio atlyginimo už futbolininko perleidimą

Birželio 19 d. Lietuvos Aukščiausiasis Teismas išnagrinėjo civilinę bylą, kurioje buvo sprendžiama, ar Tarptautinės futbolo federacijos (FIFA) statute esanti arbitražinė išlyga taikytina tarp FIFA licencijuoto agento ir futbolo klubo „Dainava“ kilusiam ginčui dėl komisinio atlyginimo už futbolininko perleidimą išspręsti. Byloje buvo nustatyta, kad, pagal FIFA statuto 56 straipsnį, FIFA pripažįsta nepriklausomą Sporto arbitražo teismą (CAS), kurio būstinė įsikūrusi Lozanoje (Šveicarija) ir kuris sprendžia FIFA, asociacijų narių, konfederacijų, lygų, klubų, žaidėjų, pareigūnų, tarpininkų ir licencijuotų agentų ginčus. Pagal FIFA statuto 58 straipsnio 1 dalį, konfederacijos, asociacijos narės ir lygos susitaria pripažinti CAS kaip nepriklausomą teisminę instituciją ir užtikrinti, kad jų nariai, asocijuoti žaidėjai ir pareigūnai vykdytų CAS priimtus sprendimus. Tas pats įsipareigojimas taikomas futbolo agentams ir rungtynių agentams, kurie turi FIFA licenciją. Pagal FIFA statuto 58 straipsnio 2 dalį, draudžiama kreiptis į bendrosios kompetencijos teismus, išskyrus atvejus, kai tai konkrečiai nustatyta FIFA taisyklėse.

Ieškovu byloje buvo FIFA licencijuotas agentas, o atsakove – viešoji įstaiga Dzūkijos futbolo klubas „Dainava“, kuri yra Alytaus apskrities futbolo federacijos narė, o pastaroji yra Lietuvos futbolo federacijos (LFF) narė. Atsižvelgdamas į FIFA statutą, LFF ir Alytaus apskrities futbolo federacijos įstatus, Lietuvos Aukščiausiasis Teismas padarė išvadą, kad tiek ieškovas, kaip FIFA licencijuotas agentas, tiek atsakovė yra įsipareigoję laikytis ir vykdyti FIFA statute įtvirtintą įsipareigojimą dėl Tarptautinio sporto arbitražo jurisdikcijos pripažinimo, sprendžiant bet kokius iš su futbolo sportu susijusios veiklos kilusius ginčus.

Lietuos Aukščiausiasis Teismas išaiškino, kad FIFA statuto 56 ir 58 straipsnių nuostatose nėra nuorodos į arbitruotino CAS ginčo pobūdį, todėl įtvirtinta arbitražinė išlyga siejama ne su ginčo pobūdžiu, o su subjektais, tarp kurių kyla ginčas. Tai reiškia, kad FIFA statute įtvirtinta plataus pobūdžio arbitražinė išlyga, t. y. bet kokie tarp asmenų, pripažįstančių ir besilaikančių ar įsipareigojusių laikytis FIFA statuto, kilę ginčai iš futbolo sporto veiklos turi būti sprendžiami CAS. Ši išlyga netaikoma tik tokiems ginčams, kurie tiesiogiai kaip nearbitruotini CAS nurodomi FIFA statute.

Anot teisėjų kolegijos, abiejų ginčo šalių įsipareigojimas laikytis FIFA statute įtvirtintų nuostatų, kuriose yra nuoroda į visų ginčų arbitruotinumą, yra pakankamas sutartinių teisinių santykių dėl arbitražinės išlygos egzistavimui konstatuoti.

Taip pat Lietuvos Aukščiausiasis Teismas pažymėjo, kad ginčų sprendimas CAS vieninteliame arbitraže dėl sporto ginčų specifikos (pvz., poreikio išnagrinėti ginčą itin operatyviai, specializacijos ir kt., pačių teisinių santykių specifikos, poreikio užtikrinti vienodos praktikos taikymą sprendžiant iš sporto veiklos kylančius tarptautinius ir nacionalinius ginčus, taip pat užtikrinti konfidencialumą) yra nagrinėjamai sričiai įprastas ginčų sprendimo būdas.

Todėl Lietuvos Aukščiausiasis Teismas paliko byloje nepakeistus teismų priimtus procesinius sprendimus, kuriais ieškovo ieškinys atsakovei dėl skolos priteisimo paliktas nenagrinėtas.

However, as we’ve seen in cases like Superleague, the CJEU doesn’t always follow the AG’s conclusions, so this ongoing match is far from over yet.
